1. About Our Service

Booking Requests SA operates an online platform that connects travellers looking for accommodation with independent providers. We are a facilitator and advertising platform only. We do not own, manage, supervise or endorse any property or provider listed on or using our platform.

Travellers submit a booking request with their destination, property type, rooms and max price, and registered providers purchase access to those requests and contact the traveller directly. All subsequent arrangements, including quotations, availability, bookings and payment, are made directly between the provider and the guest.

2. No Agency or Partnership

Providers using our platform are independent third parties and not employees, agents, partners or representatives of Booking Requests SA. Nothing in these terms creates any employment, agency, joint venture or partnership relationship between Booking Requests SA and any provider or guest.

Booking Requests SA does not arrange, supervise, guarantee or warrant any booking, stay or accommodation provided by any provider.

3. Third-Party Agreements Between Provider and Guest

Any agreement entered into between a provider and a guest — whether oral or written, relating to rates, deposits, cancellation, check-in, guarantees or payment — is strictly a third-party agreement between those two parties.

Booking Requests SA is not a party to any such agreement, does not negotiate its terms, and accepts no liability arising from it. The guest and the provider each indemnify and hold Booking Requests SA, its owners, staff and agents, harmless from and against any and all claims, demands, losses, damages, costs and expenses (including legal costs) of any nature arising directly or indirectly out of any agreement, dispute or transaction between the provider and the guest.

4. Payments

All payments for accommodation are made by the guest directly to the provider. Booking Requests SA never receives, holds, processes or handles any payment for a booking, and accepts no responsibility for deposits, refunds or any financial dispute between a guest and a provider.

Fees charged by Booking Requests SA (such as the purchase price of a request) are for access to guest request information only and are not payment for any accommodation.

5. Provider Purchases and Access

Request details, including a guest's name and WhatsApp number, are released to a provider only once the request has been purchased. Purchased request information is licensed to the purchasing provider for the sole purpose of contacting that guest about their stated requirements.

Purchased requests are non-refundable once guest contact details have been released, except where the request is proven to be fraudulent or materially inaccurate, at the sole discretion of Booking Requests SA.

6. Limitation of Liability

To the maximum extent permitted by South African law, Booking Requests SA shall not be liable for any loss, damage, injury, death, delay, consequential loss, financial loss or loss of profit arising from or in connection with:

• Any accommodation, service or advice provided by any provider to any guest;
• Any agreement, dispute or transaction between a provider and a guest;
• The accuracy, completeness or truthfulness of information submitted by guests or providers on the platform;
• The quality, safety, legality or fitness for purpose of any property or stay;
• Any failure, outage or unavailability of the platform, or any loss of data.

7. Indemnity

By using this platform, both guests and providers fully indemnify and hold harmless Booking Requests SA, its owners, staff and agents from and against any and all claims, actions, liabilities, losses, damages and expenses (including reasonable legal fees) arising out of or relating to their use of the platform, their dealings with one another, or any breach of these terms.

8. Guest Responsibilities

Guests agree to submit accurate and truthful information about their travel plans and requirements, to deal and pay providers directly, to exercise their own judgement when choosing a provider, and to satisfy themselves as to a property's suitability before booking.

Guests should obtain and retain their own written record of any quotation, booking confirmation or invoice with a provider.

9. Provider Responsibilities

Providers represent that they are legally entitled to offer the accommodation they list, that all details claimed in registration are true, and that they conduct themselves professionally and lawfully at all times.

Providers must keep all guest information confidential, use it solely for the stated request, and may not resell, share or misuse guest contact details.

10. Intellectual Property

All content on this website, including text, design, logos and graphics, is the property of Booking Requests SA and may not be copied, reproduced or used without written permission.

11. Changes to These Terms

Booking Requests SA may update these Terms & Conditions at any time. The current version will always be published on this page, and continued use of the platform constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of South Africa, and the courts of South Africa shall have exclusive jurisdiction over any dispute arising from them.
